Federal Judge in San Antonio declares Texas same-sex marriage ban unconstitutional

This is exciting news for Texans and advocates of gay marriage!  Per the Texas Tribune article, Judge Orlindo Garcia ruled "that the same-sex marriage ban 'violates plaintiffs' equal protection and due process rights under the Fourteenth Amendment to the United States Constitution. Though he struck down the ban, he has stayed the effect of the ruling, meaning same-sex couples will not immediately be able to get married in Texas. Another federal court in Austin has pending cases challenging the same-sex marriage ban.

Attorney General Greg Abbott, who was a defendant in the case along with Gov.Rick Perry, said in a statement that he will appeal Judge Garcia's decision, adding that it "should be overturned and the Texas Constitution will be upheld."

Sperm Donors and Non-Bio Parents Beware

This story is an important one as many lesbian couples start families by working with a "known" donor (a friend, relative) instead of a sperm bank.  This article highlights the inherent pitfalls of what happens when the lesbian parents separate and the custodial parent (bio mom) applies for state benefits.  The state will intervene to establish paternity, especially here in Texas, to recapture monies from the "Dad".  Therefore, it is crucial that the parties work together to terminate any "rights" of the "donor" and have the non-biological parent adopt the child.  Then, the state will come after the "legal" non-bio parent to establish child support instead of the donor.
